It’s bad enough when someone gets behind the wheel of a car despite their driver’s license being revoked years ago. But if a person also violates traffic regulations, it is completely stupid. So far a 34-year-old woman from the area should have thought better not to be convicted in Wolfrachauser County Court of intentional driving without a license. Especially because she had previously been convicted of drunk driving. But her expectation to surprise someone is the reason for her misbehavior.
Because the appropriate gift for her friend on her birthday, she believes, can only be a car. She bought the right used car for 500 euros and drove herself on January 25 of this year to bring the car a few kilometers away to Wolfratshausen. The defendant said that she thought her friend would be happier if she surprised her personally.
When the woman was driving on the Sauerlacher Strasse in Wolfratshausen, she was typing on her mobile phone at the same time. This was noticed by the police who examined her. Because anyone who picks up their cell phone while driving is committing a traffic violation. Rather than simply admitting that she no longer had a driver’s license, the woman claimed she had a temporary driver’s license document and just left her at home. It was easy for the police to determine that this was not the case.
Defense attorney Burkhard Pappas was right when he spoke in court of great stupidity that arose from serving a friend. Admit that talking on the phone while driving is really stupid. He demanded that the fine not exceed at least 90 per day – the limit for which a person exceeding a criminal record would be considered. His client was clearly affected by the criminal proceedings. It was naive that she wanted to pretend to the police that she had a driver’s license.
The public prosecutor also found it sufficient to impose another fine. However, this would have to be much higher at 150 €25 per day, which is €3,750, for the defendant to be warned to act in accordance with the law in the future.
Criminal Judge Helmut Berger spoke of a “really sad story”. If the defendant had acted inconspicuously rather than fiddling with the mobile phone, it may have never been examined. The woman was sentenced to a fine of 120 per day (25 euros). In total, this is 3,000 euros, which is six times the cost of buying the same car.
By the way, the defendant was not so lucky in the car. “An engine failure occurred shortly after that,” she said. The first thing she wanted to do was apologize for being so stupid as to trick the police into getting a driver’s license. “I’m really sorry, I learned from her,” she said. Now you hope you’ll never be in the dock in a courtroom again.
