However, the General Rapporteur, who often follows the opinions of administrative judges, noted that the existence of “agricultural activity” must be “consistent” enough to benefit from this type of exemption. However, in this file there is a “brief description without supporting documents” of said “activity”.

A farm… three poultry

The arguments of the plaintiff – who was not present and was not represented by a lawyer at the hearing – are furthermore “not serious”, according to the judge: On the occasion of filing a complaint with the gendarmerie, The applicant allegedly “declared to own three poultry”. “Who does little for education”, So the general rapporteur joked.

In the end, the General Rapporteur recommended that the Administrative Court reject his request. “The master does not seem to be interested in this lawsuit which he himself has initiated,” simply commented the Saint-Flyes-de-Loup municipal attorney, so that the judges would order the applicant to pay his legal costs.

On this last point, the applicant requests 1,500 euros from the municipality for the same reason. The Administrative Court of Nantes, which has retained its decision, will issue its verdict in about a month.
